Terms of Service

Welcome to Wayfinder. These Terms of Service ("Terms") govern your use of the Wayfinder platform (the "Service"), operated by Virtuous Capital Foundation, a 501(c)(3) nonprofit organization. By accessing and using Wayfinder, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

1. Acceptance of Terms

By creating an account and using Wayfinder, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including any policies referenced herein. If you are using Wayfinder on behalf of a minor under 13, you represent that you have parental consent and authority to agree to these Terms on their behalf.

These Terms apply to all users of Wayfinder, including those who visit our website but do not create an account. Your access to and use of Wayfinder is conditioned upon your acceptance of these Terms.

2. Description of Service

What Wayfinder Is

Wayfinder is an AI-powered career advisor platform designed to provide personalized career guidance, educational planning advice, and career exploration resources to students and career changers ages 13 and older. The service leverages Wayfinder's proprietary AI engine to deliver conversational career guidance.

Service Features

Wayfinder provides the following services:

• Personalized career assessments and recommendations
• AI-powered conversational career guidance
• Educational pathway planning
• Career research and exploration tools
• Goal-setting and progress tracking features

Information Accuracy

While we strive to provide accurate and current information, career landscapes, educational programs, and industry requirements change constantly. Information provided through Wayfinder may not always be completely accurate, up-to-date, or applicable to your specific circumstances. You are responsible for verifying any important information with authoritative sources and qualified professionals before acting upon it.

3. Account Registration

Eligibility and Age Requirements

To use Wayfinder, you must be at least 13 years old. By creating an account, you confirm that:

• You are at least 13 years of age
• You have the legal authority to enter into these Terms
• If you are under 18, you have parental or guardian consent to use Wayfinder
• You are not legally prohibited from using online services in your jurisdiction

Account Information

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Update your information promptly if any details change
• Choose a secure password and not share it with others
• Not use offensive, threatening, or false information in your profile

Account Security

You are responsible for maintaining the confidentiality of your account login credentials and password. You are fully responsible for all activities that occur under your account. You must immediately notify Wayfinder of any unauthorized access or security breach. Wayfinder is not liable for any losses resulting from unauthorized use of your account.

Account Termination

You may delete your account at any time through your account settings. When you delete your account, you will lose access to all conversations, saved recommendations, and data associated with your account.

4. Acceptable Use

Prohibited Conduct

You agree not to use Wayfinder in any manner that:

• Illegal Activities: Violates any law, regulation, or third-party rights, including intellectual property rights
• Harmful Content: Contains threats, harassment, violence, hate speech, or discriminatory language toward individuals or groups
• Abuse: Harasses, bullies, intimidates, or otherwise abuses other users or Wayfinder staff
• Spam and Manipulation: Sends spam, scams, phishing attempts, or uses the service for unsolicited advertising
• Unauthorized Access: Attempts to gain unauthorized access to Wayfinder's systems, data, or accounts
• Reverse Engineering: Attempts to reverse engineer, decompile, or discover the underlying code or algorithms of Wayfinder
• Scraping and Bots: Uses automated tools, bots, scraping software, or other mechanisms to access or extract data from Wayfinder without permission
• Impersonation: Impersonates another person or entity, including Virtuous Capital Foundation staff or career professionals
• Misinformation: Intentionally spreads false or misleading information through the platform
• Copyright Violation: Uploads, shares, or distributes copyrighted content without proper authorization

Monitoring and Enforcement

Wayfinder reserves the right to monitor user activity for compliance with these Terms. We may remove content, suspend accounts, or terminate access to users who violate these Terms. We are not obligated to notify you before taking such action, though we will attempt to do so when feasible.

Rate Limiting and Fair Use

To ensure fair access and platform stability, Wayfinder enforces rate limits on API usage:

• Automated Access Prohibited: You may not use bots, scripts, or automated tools to access Wayfinder without explicit written permission
• Rate Limits by Plan: Each subscription tier includes specified rate limits on queries and API calls. These limits are enforced to provide equitable access to all users
• Abuse Detection: Wayfinder monitors for unusual patterns of access, including rapid-fire requests, bulk data extraction attempts, or other activities that exceed normal usage
• Enforcement: Users who exceed rate limits or engage in abusive access patterns may face temporary rate limiting, service suspension, or permanent termination of their account

5. Subscription Plans & Payments

Available Plans

Wayfinder offers the following subscription tiers:

• Career Explorer (Free): $0/month - Basic career guidance, 3 Wayfinder Engine queries/day, demographics preview, 1 invitation
• Coach: $25/month - Full demographics, 20 Engine queries/day, admissions timeline, internships preview, scholarships & programs preview, decision date reminders, essay reviewer add-on, ED & EA holistic strategy, 5 invitations
• Consultant: $50/month - All Coach features plus full internships/scholarships/programs databases, demographics comparison, 40 Engine queries/day, all reminder types, advanced ED & EA strategy, 10 invitations

Essay Review Credits

In addition to subscription plans, Wayfinder offers consumption-based essay review credits as an add-on available for Coach and Consultant subscribers:

• 5 reviews for $10
• 10 reviews for $15
• 20 reviews for $20

Essay review credits are non-refundable and do not expire while your account is active. Credits are one-time purchases and not recurring charges.

Payment Processing

All payments are processed securely by Stripe, our third-party payment processor. By providing payment information, you authorize Stripe to charge your payment method according to the plan you select. Your credit card information is not stored on Wayfinder's servers; payment processing is handled entirely by Stripe's secure systems.

Billing and Auto-Renewal

Paid subscriptions are billed on a monthly basis:

• Your subscription will automatically renew each month on the anniversary of your purchase date
• You will be charged the current subscription price at the time of renewal
• Wayfinder reserves the right to change subscription prices with 30 days' notice
• You will receive a billing confirmation email after each charge

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle. You will retain access to premium features through the end of your paid period; no refunds will be issued for the remainder of your current month.

Refund Policy

Failed Payments

If a payment fails, Wayfinder will attempt to retry billing using the payment method on file. If payment ultimately fails, your account may be downgraded to the Free plan or suspended until payment is received. Repeated failed payments may result in account termination.

5.1. Service Availability

Dependency on Third-Party Services

Wayfinder relies on several third-party services to operate:

• Wayfinder AI Engine: Intelligent advisory processing and career guidance
• Stripe: Payment processing and subscription management
• Render: Infrastructure and hosting
• Resend: Email delivery for notifications and reminders

Service availability depends on the continued operation and reliability of these third-party providers.

No Uptime Guarantee or SLA

Wayfinder does not guarantee any specific level of service availability, uptime, or performance. We do not maintain a formal Service Level Agreement (SLA). The Service is provided on an "as-available" basis without guarantees of uninterrupted access.

Service Interruptions

Wayfinder may experience interruptions due to:

• Scheduled maintenance and system updates
• Unscheduled maintenance necessary to address security issues or system failures
• Third-party service outages or failures beyond our control
• Network failures or infrastructure issues
• High traffic or resource constraints

We will attempt to provide notice of scheduled maintenance, but emergency maintenance may occur without advance notice.

Right to Modify or Discontinue

Wayfinder reserves the right to:

• Modify, suspend, or discontinue any feature or service at any time
• Change pricing, features, or functionality
• Impose usage limits or rate restrictions
• Discontinue the Service entirely

While we will attempt to provide notice of material changes, we are not required to do so. Your continued use of Wayfinder constitutes acceptance of any modifications.

6. Intellectual Property

Wayfinder's Intellectual Property

Wayfinder, including all content, code, features, and design, is owned by Virtuous Capital Foundation or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use Wayfinder for personal, non-commercial purposes in accordance with these Terms. You do not own or have any right to the Wayfinder platform or its underlying technology.

Wayfinder's curated databases containing internship, scholarship, program, admissions, and demographic analysis data are proprietary and confidential. These databases represent significant research, curation, and investment by Virtuous Capital Foundation.

User Content License

Any content you create, upload, or provide to Wayfinder (including conversations, questions, profiles, and recommendations) remains your property. However, by submitting content to Wayfinder, you grant Wayfinder a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content as necessary to provide and improve the Service. This includes using your conversation data to train and improve our AI models.

Restrictions on Use

You may not:

• Copy, modify, or create derivative works of Wayfinder
• Reverse engineer or attempt to discover the underlying code or algorithms
• Remove or alter any copyright, trademark, or proprietary notices
• Use Wayfinder for any commercial purpose without written permission
• Sublicense or sell access to Wayfinder to third parties
• Reproduce, distribute, scrape, or create derivative works from Wayfinder's curated databases (internships, scholarships, programs, admissions data, demographic analysis)
• Access or use database content for any purpose other than personal career guidance and planning

Database content is licensed for personal use only. Any unauthorized reproduction, distribution, or commercial use of database content is strictly prohibited and may result in legal action.

Third-Party Content

Wayfinder may contain links to or references to third-party websites, content, and services. Wayfinder is not responsible for the accuracy, legality, or content of third-party materials. Your use of third-party sites is governed by their own terms and policies.

7. AI Disclaimer

AI-Generated Content

Wayfinder's guidance is generated by Wayfinder's AI engine, a proprietary RAG-architected advisory system. While Wayfinder is a sophisticated advisory platform, it is not a human career counselor. AI-generated content should be understood as:

• Informational and educational in nature
• Based on patterns in training data, not professional expertise
• Subject to errors, hallucinations, and inaccuracies
• Not personalized to your specific circumstances, needs, or goals
• Not a substitute for professional human judgment and expertise

Limitations of AI Career Guidance

You acknowledge and understand that:

• Not a Substitute for Professional Counseling: Wayfinder is not a substitute for consulting with certified career counselors, academic advisors, financial advisors, or mental health professionals. Important decisions about your education, career, and finances should only be made after consulting qualified human professionals.
• Accuracy Not Guaranteed: AI-generated information may contain errors, outdated information, biases, or inappropriate suggestions. Information about specific careers, educational programs, and industry requirements may be inaccurate or no longer current.
• Individual Circumstances: The AI cannot fully understand your unique situation, constraints, abilities, values, or priorities. What works for one person may not work for you.
• No Accountability: The AI has no accountability for the consequences of its advice. Only human professionals bear responsibility for the advice they provide.
• No Licensing or Credentials: The AI is not a licensed or credentialed career counselor, academic advisor, or financial advisor. It cannot provide the same quality of guidance as qualified professionals.

Your Responsibility

You are solely responsible for:

• Verifying any important information provided by Wayfinder with authoritative sources
• Consulting qualified professionals before making decisions based on Wayfinder's guidance
• Evaluating whether Wayfinder's suggestions are appropriate for your situation
• Understanding the limitations of AI-generated advice

Bias and Fairness

AI systems can reflect biases present in their training data. Wayfinder's guidance may reflect gender, racial, socioeconomic, or other biases. While we work to mitigate these biases, we cannot eliminate them completely. You should be aware of potential biases when evaluating Wayfinder's suggestions.

College Admissions Disclaimer

No Guarantee of Admission: Wayfinder does not guarantee admission to any college or university. Essay review scores are AI-generated assessments and are not predictive of actual admissions outcomes. Admissions decisions are made by human admissions officers and depend on many factors beyond essay quality.

Timeline and Strategy Information: Timeline and strategy recommendations provided by Wayfinder are informational in nature and should not replace guidance from school counselors or admissions professionals. You should discuss any significant educational or college planning decisions with qualified school counselors and admissions advisors.

Database Information Accuracy: Scholarship, internship, and program information may change without notice. Deadlines, eligibility requirements, and awards amounts are subject to change by the originating institutions. You are responsible for verifying current information directly with the originating institution before applying or committing to any program.

ED/EA Strategy Guidance: Early Decision (ED) and Early Action (EA) strategy guidance provided by Wayfinder is informational only. ED and EA are binding or non-binding agreements with specific institutional policies. Before making any binding decision like Early Decision, you must fully understand the institutional policies and implications. Consult with school counselors and admissions professionals before committing to ED or EA.

No Warranties

Wayfinder makes no warranties that the information provided is accurate, complete, current, or suitable for your purposes. The Service is provided "as-is" without warranties of any kind, express or implied.

Essay Review Disclaimer

• Not Professional Editing: Essay reviews are generated by Wayfinder's AI engine and do not constitute professional writing, editing, or admissions consulting services
• No Guarantee of Admission: Wayfinder makes no guarantee, representation, or warranty that following essay review suggestions will result in college admission, improved essay scores, or any specific outcome
• No Liability for Admissions Outcomes: Wayfinder is not liable for admissions decisions, rejections, or outcomes of any kind based on essays reviewed through our service
• Third-Party AI Processing: Essays are processed by Wayfinder's AI engine. By submitting essays for review, you acknowledge and consent to this AI processing
• Data Privacy for Essays: Essay content is handled according to our Privacy Policy and Wayfinder's data practices. Please review our policy before submitting sensitive content
• Human Review Recommended: We strongly recommend that you have your essays reviewed by human professionals, including teachers, counselors, or professional editors, before submission

8. Limitation of Liability

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, WAYFINDER IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WAYFINDER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Damages

UNDER NO CIRCUMSTANCES SHALL VIRTUOUS CAPITAL FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF WAYFINDER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OPPORTUNITY, OR GOODWILL, EVEN IF WAYFINDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Cap on Liability

TO THE EXTENT PERMITTED BY LAW, VIRTUOUS CAPITAL FOUNDATION'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR A WAYFINDER SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS. FOR USERS OF THE FREE PLAN, LIABILITY IS LIMITED TO $50.

Assumption of Risk

You acknowledge that your use of Wayfinder is at your own risk. You assume all risk and responsibility for any decisions made based on information provided by Wayfinder. Wayfinder is not responsible for any consequences of your reliance on AI-generated guidance.

No Guarantee of Accuracy

Wayfinder does not guarantee the accuracy, completeness, timeliness, or appropriateness of any information provided. You use Wayfinder with the understanding that important decisions should only be made after consulting qualified professionals.

9. Indemnification

You agree to indemnify, defend, and hold harmless Virtuous Capital Foundation, its officers, directors, employees, agents, and successors from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms of Service
• Your reliance on information, guidance, assessments, or recommendations provided by Wayfinder
• Any content you submit, upload, or provide through the Service
• Decisions made based on essay reviews, timeline recommendations, strategy guidance, or other AI-generated analysis provided by Wayfinder
• Your use of data, information, or resources accessed through Wayfinder

This indemnification obligation applies regardless of whether Wayfinder has been advised of the possibility of such damages and survives termination of your account or these Terms.

10. Dispute Resolution

Informal Resolution

If you have a dispute with Wayfinder, you agree that you will first attempt to resolve the matter through good faith communication. Please contact Wayfinder at support@wayfinderai.org describing your dispute. Both parties will have 30 days to attempt to resolve the dispute amicably before pursuing formal proceedings.

Binding Arbitration

If the dispute cannot be resolved within 30 days, you agree that any claim, dispute, or controversy (including the interpretation, formation, breach, or enforcement of these Terms) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Washington State. The arbitrator shall apply applicable substantive law and may award any relief that would be available in court under applicable law. Each party shall bear its own attorney's fees and costs, and the parties shall split the arbitrator's and AAA's fees equally.

Class Action Waiver

You agree that you may only bring claims in your individual capacity and not as a plaintiff or class member in any purported class or representative action or proceeding. The arbitrator cannot consolidate claims of multiple parties or engage in class arbitration.

Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual claim in small claims court for claims under $10,000 if the claim qualifies for small claims court jurisdiction in the relevant jurisdiction.

11. Data Breach Notification

Breach Notification Commitment

In the event of a confirmed data breach that compromises the confidentiality, integrity, or security of personal information, Wayfinder is committed to notifying affected users promptly. We will notify you as soon as reasonably practical, but in no case later than 72 hours after confirming the breach.

Notification Methods

Breach notifications will be provided through multiple channels to ensure you receive the information:

• Email Notification: We will send a detailed notification email to the email address associated with your Wayfinder account
• In-App Notice: If you are logged into Wayfinder when we discover a breach, you will see an urgent in-app notification
• Website Notice: A notice may be posted on the Wayfinder website and social media channels

Breach Notification Content

Breach notifications will include the following information, to the extent known:

• Description of what happened and the nature of the security incident
• Identification of what types of personal information were affected (e.g., names, email addresses, passwords, etc.)
• Steps you should take to protect yourself (e.g., change your password, monitor your accounts)
• Mitigation measures we have taken or are taking to prevent future breaches
• Contact information for questions and assistance

Your Responsibility

Upon notification of a breach, you should:

• Change your Wayfinder password immediately
• Monitor your accounts and financial information for suspicious activity
• Contact Wayfinder at privacy@wayfinderai.org if you have questions or concerns
• Review the detailed information provided in the breach notification

Law Enforcement Cooperation

If we are required by law enforcement or legal process to delay notification of a breach, we will cooperate with such requests. Once the legal hold is lifted, we will promptly notify affected users.

12. Privacy

Your use of Wayfinder is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy at /privacy to understand our practices regarding the collection, use, and protection of your personal information.

By using Wayfinder, you acknowledge that your conversations and profile information will be processed by Wayfinder's AI engine as part of the advisory service, as described in our Privacy Policy.

13. Termination

Termination by You

You may terminate your account at any time by logging into your account and selecting "Delete Account." When you delete your account, our cascade-deletion process runs immediately:

• You immediately lose access to Wayfinder
• Your account file is deleted from the persistent store
• All conversation sessions linked to your account are deleted
• All memory chunks and training-pair records tied to those sessions are scrubbed from the learning system
• An anonymized tombstone (containing only a hashed user identifier and counts — no personal information) is appended for compliance audit purposes
• Within 7 days, the daily-snapshot rotation completes and your data is gone from backups too
• No refunds will be issued for any remaining subscription period

Deletion is immediate and irreversible. There is no soft-delete or 30-day grace period.

Termination by Wayfinder

Wayfinder may terminate or suspend your account immediately and without notice if:

• You violate these Terms of Service
• You engage in illegal activity or activity that threatens the security of Wayfinder
• You abuse the service or other users
• You fail to pay subscription charges and do not resolve the issue after notice
• We determine in our sole discretion that continuing your account is inappropriate

Effect of Termination

Upon termination by Wayfinder or you:

• Your right to use Wayfinder immediately ceases
• We may delete your account and all associated data
• No refunds will be issued
• You remain liable for any unpaid charges

Data After Termination

After your account is terminated, we will delete your personal data according to our Privacy Policy. However, we may retain anonymized or aggregated data for research and improvement purposes.

14. Survival Clause

Survival of Terms Upon Termination

Certain sections of these Terms of Service shall survive termination of your account or these Terms and shall continue to apply indefinitely:

• Limitation of Liability (Section 8): Your liability protections and limitations on damages continue after termination
• Indemnification (Section 9): Your obligation to indemnify Wayfinder survives termination
• Intellectual Property (Section 6): Wayfinder's intellectual property rights and your license restrictions survive termination
• Dispute Resolution (Section 10): Binding arbitration and class action waiver apply to disputes arising before or after termination
• Data Breach Notification (Section 11): Our obligations to notify you of breaches continue
• Governing Law (Section 15): Washington State law governs these Terms after termination

Effect of Survival

The survival of these provisions means that termination of your account does not relieve you or Wayfinder of obligations or liabilities that were incurred or accrued before termination. You remain bound by these provisions even after your account is deleted or access is terminated.

15. Changes to Terms

Right to Modify

Wayfinder reserves the right to modify these Terms at any time. Changes will be effective 30 days after they are posted to the Wayfinder website. For material changes, we will attempt to notify you via email to your registered email address.

Your Continued Use

Your continued use of Wayfinder after changes become effective constitutes your acceptance of the updated Terms. If you do not agree with any changes, your only recourse is to discontinue use of Wayfinder and delete your account.

Updates and Notifications

Wayfinder may update these Terms to reflect:

• Changes in our services or business practices
• New features or functionality
• Legal or regulatory requirements
• Industry best practices and standards

16. Accessibility

Commitment to Accessibility

Virtuous Capital Foundation is committed to ensuring that Wayfinder is accessible to all users, including individuals with disabilities. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at the AA level and to comply with applicable accessibility laws, including Section 508 of the Rehabilitation Act and Title III of the Americans with Disabilities Act (ADA).

Accessibility Features

We endeavor to provide:

• Keyboard-navigable interface elements
• Screen reader compatibility for core platform features
• Sufficient color contrast for text and interactive elements
• Alternative text for meaningful images and icons
• Consistent and predictable navigation patterns

Reporting Accessibility Issues

If you encounter an accessibility barrier or have difficulty using any part of Wayfinder, please contact us at accessibility@wayfinderai.org or support@wayfinderai.org. We take accessibility feedback seriously and will work to address reported issues promptly.

17. Force Majeure

Wayfinder and Virtuous Capital Foundation shall not be liable for any failure or delay in performing obligations under these Terms caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of God, war, terrorism, civil unrest, government actions or regulations, labor disputes, power failures, internet or telecommunications outages, cyberattacks, failures of third-party service providers (including Stripe, Render, or Resend), or any other cause beyond our reasonable control.

In the event of a force majeure event, the affected party's obligations shall be suspended for the duration of the event, and time for performance shall be extended accordingly. If the force majeure event continues for more than 90 days, either party may terminate these Terms by providing written notice to the other party.

18. General Provisions

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and Virtuous Capital Foundation regarding your use of Wayfinder. These Terms supersede all prior and contemporaneous agreements, proposals, and communications, whether written or oral, relating to the subject matter herein.

Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of Virtuous Capital Foundation. Wayfinder may assign its rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of its assets. Any attempted assignment in violation of this section shall be void.

Waiver

The failure of Wayfinder to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall only be effective if it is in writing and signed by an authorized representative of Virtuous Capital Foundation. No waiver shall be deemed a continuing waiver or a waiver of any other provision.

Notices

All notices from Wayfinder to you may be delivered via email to the address associated with your account, by in-app notification, or by posting on the Wayfinder website. Notices from you to Wayfinder must be sent to support@wayfinderai.org. Notices shall be deemed received when sent via email (at the time of sending), when posted on the website (at the time of posting), or when displayed as an in-app notification.

Section headings in these Terms are for convenience only and shall not affect the interpretation or construction of any provision.

Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights. No person or entity other than you and Virtuous Capital Foundation shall have the right to enforce any provision of these Terms.

19. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.

Except for disputes resolved through arbitration (as described in Section 10) or small claims court, you agree that any legal action or proceeding arising under these Terms shall be exclusively subject to the jurisdiction of the state and federal courts located in Washington State.
